How lame, its only an animation created for the enjoyment of its viewers for those 5 minutes of utter bordom at work.
Now its turning into an international law suit! Geeeze, I blame the Americans they are stupid.

thanks. but he took money from them after the fact so even though they stole it in the first place he has written a statement saying that they didn't. so basically there is nothing he can do. its a sad situation.

He did not take the money after they stole it, He quote: Alan specifically did not allow Mr. Bauman's site to post his file.

That quote is kind of conflicting... on one hand it is saying he is sending the check back, then it says that he is trying to PAY back, asking for a Paypal address... he wouldn't have to Pay back (via Paypal or otherwise) if he had not cashed the cheque in the first place. so, cheque cashed, deal closed. It just looks like he is just trying to save himself from a public bashing for 'selling out' once people reacted to his statement that it was fine for them to host the animation quote: With their constant persuasion and offers for money, they made me write a quote saying that everything was fine. Of course everything was fine for me, because I had the money they had given me.

$250 for an animation from a company that erms 1/4 a month...thats shameful. put a 1 and 2 zeros on that and that might be a deal. Full On Design

They are protecting their profits, by offering the kid an minimal amount they have provented law suits, and having their rep and money removed. for 250dollars, ebaums world has had a huge influx of hits and therefor are actually benefitting from the 'scandal'. I say it is a superb marketing scheme, and has worked well. find a good animation, 'steal' it from a site, then find the young author who doesn't have an ounce of business knowledge, offer him a lot of money (in the kids eyes) he accepts, it costs ebaums world nothing, but gains them huge amounts of Press.

hmm...i guess i CAN huh genius? but yeah, there is nothing he can do and its very sad, but he should have thought it out before he agreed to that. but didn't he say on that discussion forum or somewhere that his dad is persuing this lawsuit? i don't see how that can work.

I think his dad can claim that he is a minor, and still legally a child and still the responsability of the parents.
Without the consent of the parents he sold his work, which maybe they can claim that he was ni-eve (sp) and didn't know what he was doing. Doubt very much it will work.

....k. but yeah, i doubt that would work since he wasn't 12, he was 17. also i think the statement he signed said that they paid his BEFORE they posted the animation thingy so....but can he work that to his advantage somehow? like they were doing something illegal from that point of view?

he probably remembered it was around and looked for it.
and all i'm saying is that HE SIGNED A STATEMENT SAYING THAT THEY HAD PAID HIM FOR THE ANIMATION BEFORE THEY PUT IT UP AND HE THUS GAVE THEM PERMISSION TO PUT IT UP so there is nothing he can do about that portion of it because that statement would be considered a binding legal document. so i was thinking maybe a way he could catch them would be through the statement because it was basically a lie.
why do you keep taking everything i write wrong? i swear you do it on purpose.

Why do you have to write in caps? I really want to see what happens with this, becauses hes under 18 he should have really had a parent sign the document with him. Anyone up for making a pertission (sp) to shut down Ebaums and make him give all his moneys to me or charity? Full On Design

no.
and in the U.S. the whole "minor" thing is up for debate. you can be legally tried as an adult at 15 or 16 so the fact that he was under 18 means practically nothing.
and i write in caps because i hope it will stand out and you'd actually understand what i was saying. :) but it will be interesting to see where this goes because if ebaums has been making a habit of stealing work, then the ruling on this could have some serious implications either way they decide.
